Wage and Hour & Employee Misclassification Settlement

Mr. Shirvanian represented a California employee in a heavily disputed employee misclassification as independent contractor and wage and hour and overtime violations case against the firm’s client’s former employer.  The employee claimed he was misclassified as an independent contractor where in fact he was an employee pursuant to controlling California law.  Furthermore, the employee contended that he was not paid for his wage and hour, or overtime or meal and rest periods over the course of approximately three years.

The case was postured for a full blown wage and hour litigation in Superior Court.  However, due to the experience of Mr. Shirvanian and the skilled negotiations that took place, a favorable confidential settlement was reached for the firm’s client.
